Terms of Use
The gist: CrumbDB is an app made by one person (Dan Ryan) that adds locations to your photos. Your photos and your location history are yours. We don’t claim any rights over them, and we never see them: they live on your devices and in your own iCloud account. The app is offered as is, so keep a backup of anything you care about. If you pay for CrumbDB Pro, Apple handles the billing. Be reasonable, and we will be too.
These terms are adapted from the Prideraiser terms, which are in turn based on work by Editorially, all shared under a Creative Commons ShareAlike license. You’re welcome to reuse them under the same terms. Swap our name for yours.
1. The agreement
These terms cover the CrumbDB app on iPhone and Mac, and this website. By installing or using CrumbDB you agree to them, along with our Privacy Policy. If you don’t agree, don’t use the app. Your use of the app is also subject to Apple’s standard Licensed Application End User License Agreement, and if the two disagree, Apple’s agreement wins for anything the App Store governs.
We refer to Dan Ryan as “we” throughout, because it is one person.
2. Your content stays yours
CrumbDB reads your photo library, your location, and your workout routes to do its job. All of that is your content. We assert no rights over it of any kind. We don’t receive it, host it, or license it, and nothing in these terms gives us permission to.
When you apply a location to a photo, CrumbDB writes it through Apple’s Photos framework, which keeps the original and lets you revert the change in the Photos app. You are responsible for deciding which locations to apply and for keeping backups of your photo library.
3. Your responsibilities
You are responsible for the device the app runs on, for the permissions you grant it, and for anything you do with the locations it writes. Don’t use CrumbDB to do anything unlawful, and don’t try to interfere with the app, the service behind it, or other people’s use of it.
4. CrumbDB Pro
CrumbDB Pro is an auto-renewable annual subscription bought through the App Store. The price is shown in the app before you buy. Payment is charged to your Apple ID, the subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and you can manage or cancel it in your Apple ID settings. Refunds are handled by Apple under its policies, not by us.
We may change the price of Pro or what it includes for future periods. If we do, Apple will tell you before the change applies to you.
5. Changes to the app
CrumbDB will change over time. Features may be added, altered, or removed, and the app may stop supporting older versions of iOS or macOS. We may also discontinue the app entirely. If a change is material to these terms, we’ll note it in the changelog at the bottom of this page and on this site before it takes effect. Continuing to use the app after that means you accept the new terms.
6. Our stuff
The CrumbDB name, icon, app, and website are ours. These terms don’t transfer any of that to you, and they don’t let you copy or redistribute the app outside the App Store. Apple, iPhone, Mac, iCloud, Photos, and Health are trademarks of Apple Inc.
7. No warranty
CrumbDB is provided as is and as available. We make no promises that it will be error-free, that it will match every photo, or that every match will be right. Location matching is an estimate built from the sources you allow, and you should check a match before applying it. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of CrumbDB. Our total liability for anything to do with the app is limited to the amount you paid us for it in the twelve months before the claim. Some places don’t allow these limits, so they may not apply to you.
9. Ending things
You can stop using CrumbDB at any time by deleting it. Deleting the app removes its local data; what it stored in your iCloud account can be removed from the app’s Settings before you delete it, or through iCloud settings afterward. We may end your access to the app or the service behind it if you break these terms. Sections 2, 6, 7, and 8 survive either of us ending the agreement.
10. Law
These terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict of law rules, and any dispute will be heard in the state or federal courts in Hamilton County, Tennessee, unless the law where you live says otherwise.
11. The rest
If part of these terms turns out to be unenforceable, the rest still stands. If we don’t enforce something once, that doesn’t mean we’ve given it up. These terms are the whole agreement between us about CrumbDB, and they were written in English; a translation is for convenience and the English version controls.
